These Terms and Conditions (“Terms”) govern your access to and use of Emwhats (“we”, “us”, “our”), including our website (including emwhats.org and www.emwhats.org) and our software services. By using Emwhats, you agree to these Terms. If you do not agree, do not use the service.
1. About Emwhats
Emwhats is a web application for businesses and teams to manage customer conversations, automations, and related workflows using the WhatsApp Business Platform (Meta). The product includes a secure dashboard, optional AI-assisted features you configure, and integrations you explicitly enable.
2. The service
Emwhats provides tools for businesses to manage customer messaging and related workflows, including use of the WhatsApp Business Platform and other integrations you enable. Features, availability, and pricing may change; we will use reasonable efforts to communicate material changes that affect your use of paid services where applicable.
3. Accounts and eligibility
You must provide accurate registration information and keep it current. You are responsible for activity under your account and for safeguarding credentials. You must be legally able to enter into these Terms and, where you act on behalf of an organization, you represent that you have authority to bind that organization.
4. Acceptable use
You agree not to misuse Emwhats, including by: violating applicable law; infringing others’ rights; sending spam, unlawful, or harmful content; attempting unauthorized access to our systems or other users’ data; or circumventing technical or usage limits.
Your use of third-party platforms (such as Meta/WhatsApp or Google) is also subject to their terms and policies. You are responsible for compliance when you connect those services.
5. Intellectual property
Emwhats retains rights in the service, branding, and related materials. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes. You retain rights in content you submit; you grant us a license to host and process that content as needed to provide the service.
6. Disclaimers
The service is provided “as is” and “as available” to the fullest extent permitted by law. We disclaim warranties not expressly stated in these Terms. Third-party services and APIs may experience outages or changes outside our control.
7. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability arising out of these Terms or the service will not exceed the fees you paid us for the service in the twelve (12) months before the claim (or, if none, one hundred (100) USD). Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.
8. Termination
You may stop using Emwhats at any time. We may suspend or terminate access if you materially breach these Terms or if required for legal or security reasons. Provisions that by their nature should survive will survive termination.
9. Changes
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance where permitted by law.
